THE ISSUANCE OF ELECTRONIC COVERNOTES BY NOTARIES IN CREDIT AGREEMENTS IS ABLE TO GUARANTEE CERTAINTY, AUTHENTICITY AND LEGAL PROTECTION IN THE DIGITAL ERA

Advancements in information technology have encouraged the digitalization of notarial services through the E-Office Notary concept, including the issuance of electronic cover notes in credit agreements. Although this practice provides efficiency in banking administrative processes, it raises legal issues regarding its status, authenticity, legal certainty, and legal protection due to the absence of explicit regulations. This study aims to analyze the legal status of electronic cover notes issued by notaries based on the Law on the Notary Profession and the Law on Electronic Information and Transactions, as well as to examine their ability to provide legal certainty and protection for related parties in the digital era. Using a normative legal research method with statutory, conceptual, and analytical approaches, this study finds that electronic cover notes are merely administrative documents and do not have the status of authentic deeds. The lack of harmonization between notarial and electronic transaction regulations creates uncertainty in their implementation. Therefore, regulatory reform and harmonization are necessary to establish legal certainty regarding electronic cover notes within digital notarial services.
